SHOOT IT YOURSELF - TERMS & CONDITIONS OF BUSINESS

BOOKING FEE: To confirm your booking a non-refundable booking fee is required with the completed booking form. All cheques should be made payable to Electra Films.  Interest free monthly instalments, Direct Debit and online banking facilities are also available. Payments received form an acceptance of the terms and conditions herein. The booking fee will be deducted from the total package price. Payments made in full after the 2 calendar month deadline are considered binding and non-refundable.

PAYMENT TERMS: This is a non-refundable retainer securing Electra Films’ services for your wedding / event date. The balance must be received at this address 2 calendar months prior to the wedding / event date. Cheque / card or other payments refused by client’s bank will incur bank’s charges for the transaction. Instalment payments should be paid by Direct Debit. Late payments without prior arrangement may incur interest charges. Electra Films will not supply equipment without full payment having cleared into their account .

COPYRIGHT: On signing the Booking Form the Client agrees that Electra Films retain copyright of all edited material and may use extracts for commercial purposes.  Edited Master DVDs will be retained as the property of Electra Films and will be archived in case further copies are required.  Any reproduction of this material other than by Electra Films will be in contravention of the Copyright, Design and Patents Act 1998.  Legal action may be taken for any breech of this Act. Clients providing music for background dubbing within the film/ photo slideshow accept full responsibility for obtaining the relevant copyright licence. (Please ask for assistance if you are unsure of the procedure.)

SERVICES SUPPLIED: Electra Films agrees to hire camera(s) and accessory equipment as per booking form to the Client(s). Equipment will be delivered to and collected from agreed address and Clients agree to be available for delivery and collection as per arrangements made with Electra Films. Electra Films reserves the right to supply replacement cameras / equipment of equivalent quality if necessary. Electra Films will supply edited film online and on DVD / other agreed media including UK delivery charges.

FORCE MAJEURE: Due performance of this contract is subject to alteration or cancellation by Electra Films owing to any cause beyond their control.  Liability shall be limited to a full and complete refund of all monies paid less any reasonable out of pocket expenses incurred.  Electra Films cannot be deemed liable for any equipment or tape failure, nor circumstances beyond their control which may result in the loss of audio and / or visual recording / archived materials, whereby the same terms apply.

CHANGES OF DETAILS: Electra Films cannot be held responsible for any loss caused by changes of address or dates etc made to the booking details. Changes must be notified in writing and are deemed effective only when confirmed by Electra Films.

FILMING & EDITING: Final editing decisions remain at the Studio’s discretion and final products supplied will include footage as selected by the Studio.  The studio cannot be held responsible for any filming missed by the Clients’ chosen camera operators.  Client music choices on CD should be returned with final payment, but must be received before editing commences. Film editing will be completed in strict order of filming within 8-12 weeks; in peak season delays are possible. Complaints must be notified within 7 days of receipt of completed DVDs unless by prior arrangement. Electra Films will provide acceptable quality edited product(s). Within this time for notification, functional problems made by Electra Films will be rectified at no additional charge. Responsibility for spelling, titling and credits rest with the Clients – before editing. After 7 days from collection / delivery films may be deleted from Electra Films’ editing equipment and the Master DVD will be archived and cannot therefore be re-edited.  Any personally requested film editing changes requested by The Client - where viable - are charged at £35 per hour, payable before or upon receipt of DVD, as agreed with Electra Films.

RELEASES: The Client grants permission to Electra Films to display any film or photographic images at any future wedding fayres, demos and exhibitions, to enter them for competitions or to publish them in newspapers, magazines, Electra Films web pages, wedding organisation websites, books, TV or other media unless otherwise directed in writing at time of booking. 

PRICES: Prices are fixed at the time of booking a given date, unless extra services are requested or VAT increased.  Footage filmed outside the agreed contract schedule will be charged at £50 per camera hour or at the relevant upgraded package / enhancement / product price. Prices include delivery and collection of equipment and delivery of DVD(s). Edits delayed by client for longer than 6 months may incur additional costs relevant to charges current at time.

DENIAL OF SERVICES: Electra Films reserve the right to refuse to rent equipment at any time where we deem it in our best interest on the basis of credit, past history, or likelihood of abuse or safety precautions or possible violation of any law(s).

PERSONAL ACCIDENT: Any directions issued by Clients during filming are agreed to be at the Clients’ own risk.  Electra Films will not be held responsible for any personal accidents caused either directly or indirectly by the use of the rented equipment.  Clients are advised that cameras, tripods and equipment should not be left unattended.

CLIENT RESPONSIBILITY: Clients agree to examine equipment on receipt and to notify Electra Films immediately if there is any damage to any of the equipment. Clients agree to take reasonable care of equipment at all times and to pack it safely for return, in the condition in which it was received. The Client is solely responsible for the equipment and those who use it whilst it is in their possession and accepts full responsibility for loss or damage to the equipment. All responsibility for ensuring that the camcorder(s) are filming throughout the course of their wedding / event rests with the Client. Electra Films accepts no responsibility for missed filming opportunities throughout the hire period or for poor quality filming or loss of memory cards / recording media. Tripods provided are for ceremony and speeches and should not be left unattended at any time. 

INSURANCE: The kit hired to the Client will be covered by Electra Films insurance policy with a £250 excess. In the unlikely event that Electra Films need to make a claim the client is responsible for the £250 excess in full. In case of loss, theft or damage of equipment the Client agrees to contact Electra Films immediately. If any camera / accessory is dropped or suffers any impact and subsequently requires a service, the Client will be liable for this charge, along with any parts or kit that need to be replaced.

INDEMNITY: The Client agrees to indemnity Electra Films and its employees and agents from and against any and all losses, damages, claims or liability of any kind including legal expenses, arising from the use, condition, defects or use / operation of the equipment supplied by Electra Films. Electra Films is not responsible for any accident or injury caused either directly or indirectly by the use of the rented equipment. Electra Films is not responsible for missed filming opportunities or for poor quality filming.

PUBLIC LIABILITY & PROFESSIONAL INDEMNITY INSURANCE: Electra Films will maintain Public Liability and Professional Indemnity insurance at all times. However, in the unlikely event of a total footage failure or cancellation of this Contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the Contract.  Neither party shall be liable for any indirect or consequential loss.

DELIVERY & COLLECTION OF EQUIPMENT: The courier delivering and collecting the equipment require a signature. Should no-one be available to sign for your parcel it will not be left. It is the Clients’ responsibility to provide a delivery address where there will be someone available to sign for your parcel. Clients must keep packaging for return of equipment and use the enclosed label and packaging tape. Clients will keep a signed receipt for equipment collected by the courier.
