MARRYOKE TERMS & CONDITIONS OF BUSINESS
BOOKING FEE: To confirm your booking a non-refundable booking fee is required with the completed booking form. Interest free monthly instalments and online banking facilities are available. Payments received form an acceptance of the terms and conditions herein. The booking fee will be deducted from the total package price.
PAYMENT: The balance must be received at this address eight weeks prior to the wedding / event date. Late payment without prior arrangement will incur interest charges. Cheque or other payments refused by client’s bank will incur bank’s charges for the transaction. Instalment payments should be paid by Direct Debit.
COPYRIGHT: On signing the Booking Form the Client agrees that Electra Films retain copyright of all filmed and / photographed material and may use extracts for commercial purposes. Edited Master DVDs will be retained as the property of Electra Films and will be archived. Any reproduction of this material other than by Electra Films will be in contravention of the Copyright, Design and Patents Act 1998. Legal action may be taken for any breech of this Act. Clients providing music for background dubbing within the film/ photo slideshow accept full responsibility for obtaining the relevant copyright licence. (Please ask for assistance if you are unsure of the procedure.) Marryoke videos are subject to UK copyright law. Your Marryoke is supplied with the understanding that if you make additional copies they will require licensing, available through PRS.
FORCE MAJEURE: Due performance of this contract is subject to alteration or cancellation by Electra Films owing to any cause beyond their control including Acts of God. Liability at any time shall be limited to a full and complete refund of all monies paid.
CANCELLATION OF CONTRACT: Following the initial 14 day period this contract may not be modified or cancelled by The Client without mutual consent in writing sent Recorded Delivery and signed by both parties, whereby The Client shall forfeit any monies paid. Cancellation less than 180 days before the wedding or event date will result in the payment of the full contracted value of the contract. In the unlikely event of Electra Films being unable to attend the wedding / event they must make every reasonable effort to obtain replacements and they will be responsible for paying the replacement staff in such a case.
FAILURE TO PAY FINAL INVOICE: by the due date will be treated as a cancellation but with the invoice total as an outstanding and due debt. Legal action will be taken to recover outstanding debts including any legal fees incurred by Electra Films and interest at the current bank rates.
POSTPONEMENT: Weddings / events postponed will retain the fee if Electra Films can re-schedule for the new date and time. If the new date is unavailable the postponement will be treated under the terms of this contract as a cancellation. The total price payable if the postponed wedding / event takes place in a subsequent year will be that of the year for which the wedding has been re-scheduled.
CHANGES OF DETAILS: Electra Films cannot be held responsible for any loss caused by changes of venues, times or dates etc made to the booking details. Changes must be notified in writing by Recorded Delivery and are deemed effective only when confirmed by Electra Films.
INSURANCE & LIMITATION OF LIABILITY Electra Films will maintain Public Liability and Professional Indemnity insurance at all times. However, in the unlikely event of a total footage failure or cancellation of this Contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the Contract. Neither party shall be liable for any indirect or consequential loss.
FILMING & EDITING: Final film filming and editing decisions remain at the Studio’s discretion and final products supplied will include footage as selected by the Studio. Electra Films should provide acceptable quality products but the studio cannot guarantee any special effect, shot or interview. Client music choices should be returned with final payment and additional film option music must be received before editing commences or will be chosen by the editor. Film editing will be completed in strict order of filming; in peak season delays are possible.
COMPLAINTS must be notified within 7 days of receipt of completed DVDs unless by prior arrangement. Within this time for notification, functional problems made by Electra Films will be rectified at no additional charge. Responsibility for spelling, titling and credits rest with the Clients – before editing. After 7 days from collection / delivery films will be deleted from Electra Films’ editing equipment and the Master DVD will be archived and cannot therefore be re-edited. Any personally requested film editing changes requested by The Client - where viable - are charged at £50 per editing hour but include replacement DVDs and online uploads, payable before postage or upon collection of DVD(s), as agreed with Electra Films.
RELEASES: The Client grants permission to Electra Films to display any film or images at any future wedding fayres, demos and exhibitions, to enter them for competitions or to publish them in newspapers, magazines, Electra Films web pages, wedding organisation websites, books, TV or other media unless otherwise directed in writing at time of booking.
PRICES: Prices are fixed at the time of booking a given date, unless extra services are requested or VAT increased. Hours / products outside the agreed contract schedule will be charged at £50 per hour per camera operator or at the relevant upgraded package / enhancement / product price. Any location parking fees incurred will be paid by The Client. Travel over 60 miles - starting from the studio - will be charged at 40p per mile. Standard editing is included in package contract price. Edited product only supplied within contract. Edits delayed by client for longer than 3 months may incur additional costs relevant to charges current at time. Prices include shipping to one UK address only.
PERSONAL ACCIDENT: Any directions issued to Clients, their guests or employees during filming are agreed to be at the persons’ own risk. Electra Films will not be held responsible for any personal accidents during location film or photography.
MEALS: Clients will provide refreshments and beverages for each of Electra Films staff - not with guests when contract is for full day coverage. If not provided, Electra Films may have to leave the proceedings to seek sustenance and The Client will be billed later. Electra Films are not responsible for any filming opportunity missed during their absence in such a case.
By making payment to Electra Films either for the booking fee or in full and / or by signing the Marryoke Booking Form the Client acknowledges and agrees to these terms and conditions.
